Please read these Terms and Conditions carefully before using RiskTrack. By using our services, you agree to be bound by these terms. RiskTrack is a safety assistance tool and does not replace emergency services.

1. Definitions and Interpretation

  • App: RiskTrack mobile application on iOS and Android
  • Company / We / Us / Our: Kando Pro-House and Services Ltd
  • Services: All features, functions, and services provided through the App and Website
  • User / You / Your: Any person accessing or using our Services

  • SOS Alert: Emergency notification features within the App
  • Incident Report: User-submitted safety reports
  • NDPR: Nigeria Data Protection Regulation (2019)
  • Emergency Services: Official responders including police, fire, and ambulance

2. Acceptance of Terms

  • By downloading or using RiskTrack, you confirm that you accept these Terms and the Privacy Policy. If you do not agree, do not use the app.
  • Your continued use after updates to the Terms means you accept the changes.

5. User Eligibility

  • Under 18: Needs parental consent
  • Under 13: Direct parental supervision required
  • 5.2 Legal Capacity
  • Must have legal capacity to enter into contracts.
  • 5.3 Geographic Restrictions
  • International use is allowed if it complies with local laws.

6. User Registration and Accounts

  • Have stable internet connection
  • Keep app updated
  • Grant necessary permissions
  • Reminder: RiskTrack’s performance relies on your device’s correct settings and connectivity.

8. Emergency Disclaimer

RiskTrack is not a replacement for emergency services. In urgent cases, contact emergency responders directly.

12. Subscription Plans and Payments

  • Plans include Free Plan and Safer Packages for local (Nigeria) and international users.
  • Free Plan: Basic SOS, community reporting, limited history
  • Safer-10 / 50 / 1000 (Nigeria): From 1–50 communities
  • Safer-10E / 20E / 1000E / MaxEx (Overseas): Custom group safety plans
  • 12.2 Payment Terms
  • Secure third-party processing
  • Auto-renews unless canceled
  • Refunds per Nigerian consumer law
  • 12.3 Cancellation
  • Cancel anytime through the app or website.

13. Privacy and Data Protection

  • RiskTrack complies with NDPR and other international data laws.

14. Intellectual Property

15. User Content

  • 15.1 Ownership
  • You own your content but grant us a free license to use it for safety improvements.
  • 15.2 Standards
  • Content must be:
  • Truthful and lawful
  • Respectful of privacy
  • Free from harm or offensive material

16. Prohibited Activities

  • Strictly prohibited:
  • Hacking / unauthorized access
  • Malware or system interference
  • Data mining or scraping
  • False emergency alerts
  • Harassment or impersonation
  • Exploiting app features commercially

17. Service Availability

  • 17.1 Uptime
  • We aim for consistent uptime, but service may be interrupted by:
  • Maintenance
  • Network failures
  • Force majeure events
  • 17.2 Location Limitations
  • Service performance may vary based on your location and infrastructure.

18. Limitation of Liability

  • We are not liable for:
  • Personal harm or death
  • Lost property or data
  • Technical or third-party failures
  • Consequential damages
  • Maximum liability: ₦10,000 or past 12-months’ fees—whichever is higher.

19. Indemnification

  • You agree to indemnify us for:
  • Breaching these terms
  • Submitting false data
  • Violating laws or rights
  • Misusing emergency tools

20. Termination

  • 20.1 By User
  • You may close your account at any time.
  • 20.2 By Us
  • We may suspend your account for:
  • Violations or abuse
  • Illegal activity
  • Payment failure
  • Threats to safety or service
  • 20.3 Post-Termination
  • Access ends immediately. Your data may be deleted per our retention policy.

21. Governing Law

  • Applicable Law: Nigerian Constitution, NDPR, Cybercrimes Act, Consumer Protection Act, CAMA 2020
  • Jurisdiction: Lagos State courts and Federal High Court of Nigeria

22. Dispute Resolution

  • 22.1 Informal Efforts
  • We will try to resolve issues informally within 30 days.

  • Unresolved disputes may go to arbitration under Nigerian law.
  • 22.3 No Class Actions
  • You waive rights to class action suits.

25. General Provisions

  • Severability: If any part is invalid, the rest remains enforceable
  • Entire Agreement: This and the Privacy Policy form the full agreement
  • No Waiver: Our failure to enforce a clause doesn’t waive it
  • Assignment: You can’t assign rights; we can
  • Force Majeure: Neither party is liable for uncontrollable events
